Justification for Exception to Fair Opportunity

This document provides the justification for procuring supplies and services on a brand name or sole-source basis, precluding full and open competition.

The justification cites the following regulatory authorities for other than full and open competition:

• FAR 13.106-1(b)(i) Soliciting from a single source
• FAR 13.106-1(b)(ii) Particular brand-name item
• FAR 8.405-6(a)(i)(1)(B) Only one source is capable of providing unique or highly specialized supplies/services.
• FAR 8.405-6(b) Items peculiar to one manufacturer (brand-name item)
• FAR 16.505(b)(2)(i)(B) Only one awardee is capable of providing unique or highly specialized supplies/services.

The justification is based on the following:

• The items must be compatible with existing systems.

• The OEM (Fluke Electronics) certified personnel are the only ones who can provide expert training as they are the subject matter experts for the 2465A Gas Piston Gauge System.

• Procuring another brand/manufacturer would result in unacceptable delays and substantial duplication of cost.

• The Corona Division has no plans at this time to compete future contracts for these supplies/services. However, they will assess feasibility if another potential source emerges.

The justification has been certified as accurate and complete by the Customer, Contract Administrator/Specialist, and Contracting Officer, indicating that this brand name/sole-source purchase is in the best interest of the Government.

Solicitation / RFP / RFQ

This is a Request for Quote (RFQ) for the "2465A Gas Piston Gauge System Install and Training." The Naval Surface Warfare Center Corona Division requires the installation and training for one (1) unit of the specified gas piston gauge system. This equipment will support the organization's Test and Measurement Diagnostic Equipment and associated components for the Calibration Standards Program.

• Procurement of one (1) "2465A Gas Piston Gauge System" (Part Number: 4319295, Serial Number: 75980, Brand: FLUKE).

• On-site installation and training by one qualified instructor.

• Training duration: 8 hours per day for 4 days (total of 32 hours).

• Training to accommodate up to 4 participants.

• All items must be TAA compliant.

• Offerors must be an OEM, authorized dealer, authorized distributor, or authorized reseller, and provide proof of authorization.

• Contract Type: Firm Fixed Price (FFP).

• This procurement utilizes FAR Part 12.

• Period of Performance: July 20, 2026, to July 23, 2026.

• Quotes are due by the date and time specified in the posting.

• All units of all items must be offered.

• Offers must be submitted on an F.O.B. basis as specified in Section F.

• Award will be made to the responsible Offeror whose quote fully complies with terms and conditions and offers a fair and reasonable price.

• Bidders must select all applicable business sizes (Small Business, Emerging Small Business, Small Disadvantaged Business, Certified under Section 8(a), HubZone, Woman Owned, Certified Service-Disabled Veteran Owned Small Business, Certified Veteran Owned Small Business, Large Business, or Other).

• The government is exempt from State and Local Taxes.

• Specific instructions regarding packaging, marking, inspection, acceptance, and payment (via Wide Area WorkFlow - WAWF) are detailed in the document.

• Item Unique Identification (IUID) is required for items with a unit cost of $5,000 or more.
