This document, "Attachment 2 Applicable Provisions and Clauses," lists and incorporates by reference numerous Federal Acquisition Regulation (FAR) and Commerce Acquisition Manual (CAM) provisions and clauses. It also includes some clauses in full text. These provisions and clauses govern the terms and conditions of the contract.

• Provisions Incorporated by Reference: Lists FAR provisions that apply to the solicitation and require offeror action or awareness. Examples include "System For Award Management" (52.204-7), "Instructions To Offerors--Commercial Products And Commercial Services" (52.212-1), and "Notice of Total Small Business Set-Aside" (52.219-6).
• Clauses Incorporated by Reference: Lists FAR clauses that will apply to the resulting contract. Examples include "Contractor Employee Whistleblower Rights" (52.203-17), "System For Award Management Maintenance" (52.204-13), and "Payment by Electronic Funds Transfer-System for Award Management" (52.232-33).

• Specific Provisions: Includes full text for "Buy American CERTIFICATE" (52.225-2), "Place of Manufacture" (52.225-18), and "SECURITY PROHIBITIONS AND EXCLUSIONS REPRESENTATIONS AND CERTIFICATIONS" (52.240-90), requiring specific offeror representations and certifications.
• Authorized Deviations: Provisions 52.252-5 and 52.252-6 indicate the use of authorized deviations in provisions and clauses, marked with "(DEVIATION)".
• Agency-Specific Clauses: Includes NIST local clauses for "AGENCY PROTESTS" (1352.233-70), "GAO AND COURT OF FEDERAL CLAIMS PROTESTS" (1352.233-71), "PLACE OF ACCEPTANCE" (1352.246-70), "CONTRACT PERFORMANCE DURING CHANGES IN NIST OPERATING STATUS," and "ELECTRONIC BILLING INSTRUCTIONS" (NIST LOCAL-53, NIST LOCAL-54, NIST LOCAL-56).

Offerors must carefully review all incorporated provisions and clauses, especially those requiring representations and certifications (e.g., Buy American, Security Prohibitions, Place of Manufacture, SAM registration). Failure to comply with these requirements may impact proposal eligibility and the terms of any resulting contract. Pay close attention to the full text of FAR 52.212-4 for critical contract terms. Bidders must also understand NIST's specific instructions regarding protests, acceptance, operating status, and electronic invoicing.

Solicitation / RFP / RFQ

This is a combined synopsis/solicitation (RFQ) for commercial products or services, specifically an amplifier (brand name AE Techron 8712 or equal). The acquisition is a 100% small business set-aside.

• The core requirement is for an amplifier meeting the specifications outlined in the attached Statement of Work (SOW).

• "Equal" products must meet the salient physical, functional, or performance characteristics specified in the SOW.

• "Equal" product submissions must clearly identify the item by brand name, make, and model number, include descriptive literature, and detail any planned modifications.

• The SOW details the characteristics and quality level required for the amplifier.

• The government intends to award a single firm-fixed-price purchase order (PO).

• Delivery and acceptance dates are detailed in the SOW.

• FOB point is specified in the SOW.

• Submission Deadline: Electronic quotations must be received by 10:00 am ET on May 21, 2026.

• Submission Method: Via email to nina.lin@nist.gov and tracy.bisson@nist.gov. Reference the RFQ number in the subject line.

• Quotation Preparation: Quotations must be clearly written, indexed (or have a Table of Contents), and logically assembled, divided into three volumes:

  • Volume I: Technical Quotation (demonstrating proposed item meets SOW requirements with citations, including manufacturer authorization if applicable).
  • Volume II: Price Quotation (firm-fixed-price for each CLIN, including shipping and other transportation charges; valid for 90 days).
  • Volume III: Terms and Conditions (completing required information from Attachment 2).

• Evaluation Criteria: Award will be made to the lowest-priced, technically acceptable quoter. The government will evaluate the lowest-priced quotation for technical acceptability first. Technical capability will be evaluated based on submitted documentation demonstrating the proposed equipment meets or exceeds all minimum requirements.

• Pre-Quote Inquiries: Written questions must be submitted via email no later than 3 calendar days after the solicitation issuance date.

• This acquisition is a 100% small business set-aside.

• Offerors must have an ACTIVE registration in the System for Award Management (SAM.gov) at the time of quotation submission, award, performance, and through final payment. Failure to maintain an active SAM.gov registration will result in the quotation not being considered for award.

• NAICS Code: 3345163 (Analytical Laboratory Instrument Manufacturing) with a small business size standard of 1,000 employees.

• The solicitation number is 1333ND26QNB030191.

• Incorporated provisions and clauses are those in effect through the RFO, supplemented by U.S. Department of Commerce Acquisition Policy.

• Attachments referenced: Statement of Work, Applicable Provisions and Clauses.

Statement of Work (SOW)

To procure one (1) brand name or equal amplifier to be integrated into NIST's Absolute Magnetometer for the development of standard reference materials (SRMs) for magnetic moment measurement. This will support the certification of new magnetic SRMs for use by government agencies, industry, and academia.

• Provide one (1) new amplifier, equivalent to the AE Techron 8712.

• The amplifier must be integrated with the NIST Absolute Magnetometer's control computer.

• Amplifier Specifications:

  • Bandwidth: DC to at least 250 kHz
  • Output Voltage: 0 to 250 VRMS
  • Output Current: 0 to 180 ARMS
  • Power: At least 12 kW
  • Slew rate: Up to 300 V/µs
  • Distortion: <0.8 %

• Documentation: Two (2) sets of manuals (hard copy or electronic) covering operation, maintenance, and troubleshooting.

• Condition: All items must be new, in original manufacturer's packaging, with all original documentation and software.

• Amplifier with power cable: One (1) unit, due no later than 6 months after receipt of order.

• Manuals: Two (2) sets, due no later than 6 months after receipt of order.

• Place of Delivery: NIST Gaithersburg.

• Delivery shall be F.O.B Destination.

• Contractor is responsible for packing, marking, and delivering the shipment in good order to the specified point of delivery.

• Visual inspection for surface defects or transport damage.

• Government reserves the right to perform performance tests to verify system specifications.

• Inspection and acceptance/rejection within 4 weeks of receipt.

• Government may require repair or replacement of damaged/nonconforming supplies at no cost.

• Minimum of one (1) year, commencing upon Government acceptance.

• Must include all materials, labor, and shipping costs.

• 100% payment after installation and acceptance by the NIST Technical Point of Contact (TPOC), upon receipt of a proper invoice.
