• FAR 52.225-2 Buy American Certificate (DEVIATION JAN 2026): Offerors must certify that end products are domestic and contain critical components, or list foreign end products and their domestic content percentage. This provision is provided in full text.

• CAR 1352.215-72 Inquiries (APR 2010): All questions concerning this solicitation must be submitted in writing to the Contract Specialist (Ranae Armstrong) with a cc to the Contracting Officer (Don Collie) no later than three calendar days after issuance. Responses will be provided in an amendment.

• FAR 52.212-4 Terms and Conditions – Commercial Products and Commercial Services (DEVIATION DATE): This clause, provided in full text, covers definitions, inspection/acceptance, assignment, changes, disputes, excusable delays, invoicing, patent indemnity, payment terms, risk of loss, taxes, termination for convenience and cause, title, warranty, limitation of liability, compliance with laws, order of precedence, unauthorized obligations, and Comptroller General examination of records.

• CAR 1352.246-70 Place of Acceptance (APR 2010): Specifies that acceptance of supplies and services will occur at the National Institute of Standards and Technology, 100 Bureau Drive, Gaithersburg, MD 20899.

• NIST LOCAL53 Contract Performance During Changes in NIST Operating Status: Provides guidance on contractor responsibilities during changes in NIST's operating status, including checking campus status lines and procedures during appropriation lapses.

• BILLING INSTRUCTIONS: NIST requires electronic invoice submissions via email to INVOICE@NIST.GOV, detailing required information. It also references the Department of Commerce Electronic Submission of Payment Requests via the Invoice Processing Platform (IPP) system, with instructions for registration and waiver requests.

• Inquiries must be submitted in writing within three days of solicitation issuance.

• Protests can be filed at the agency level or with GAO/Court of Federal Claims.

• Invoices are to be submitted electronically to INVOICE@NIST.GOV or via the IPP system.

Solicitation / RFP / RFQ

This is a combined synopsis/solicitation for commercial products or services, specifically a Request for Quotation (RFQ) for a Brand Name ONLY procurement. The government is seeking quotations for a ResinTech UPW System (Model CLiR 5400 Ultrapure Lab Water System w/UV, UF, & TOC Monitoring) and one (1) Pretreatment System (Resin Tech, model 300 GPD RO System), along with a 1-Year Service Agreement.

• CLIN 0001: UPW System (ResinTech Model CLiR 5400)

• CLIN 0002: Pretreatment System (Resin Tech, 300 GPD RO System)

• CLIN 0003: 1-Year Service Agreement

• Requirements for line items are detailed in the attached Statement of Work.

• Date(s) and place(s) of delivery and acceptance, and FOB point are required per the SOW.

• Contract Type: Firm-fixed-price purchase order (PO).

• Procurement is conducted in accordance with Revolutionary FAR Overhaul (RFO) Part 12.

• NAICS Code: 221310 (Water Supply and Irrigation System) with a small business size standard of $41 million.

• Submission Deadline: Electronic quotations due by 4:00 PM Eastern Time on 06/11/26.

• Submission Method: Email to ranae.armstrong@nist.gov with a copy to Donald.collie@nist.gov. Reference RFQ number in the subject line.

• Inquiries Deadline: Written questions due by 06/08/26 to both Contract Specialist and Contracting Officer.

• Quotation Structure: Must be divided into three volumes: Volume I – Technical Quotation, Volume II – Price Quotation, Volume III – Terms and Conditions.

• Evaluation Criteria: Award will be made to the responsible quoter with the lowest priced, technically acceptable quote.

• Technical Capability: Must clearly document that quoted products meet or exceed all specifications in the SOW. Includes manufacturer, make/model, sales literature, country of origin, and authorization to sell.

• Price: Proposed prices will be evaluated for reasonableness and compatibility with technical requirements. Shipping/delivery costs must be included.

• Award Basis: Lowest priced, technically acceptable quote.

• Discussions: Government reserves the right to make award without discussions based solely on initial quotes.

• Quoters must have an ACTIVE registration in the System for Award Management (SAM.gov) at the time of quotation submission and through award/performance/payment.
