This document is the "Indian Economic Enterprise Representation Form" required for the "Buy Indian Act." It serves as a self-certification for enterprises to confirm they meet the definition of an "Indian Economic Enterprise" as per HHSAR 326.601, in response to solicitations, RFIs, or resulting contracts.

• Eligibility Requirements: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period. Notification is required if eligibility is lost.
• Representation: Offerors must indicate whether they do or do not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."

Bidders responding to solicitations under the Buy Indian Act must complete and submit this form to self-certify their eligibility. Contracting Officers may require further documentation, and false submissions are subject to legal penalties. Successful offerors must also be registered with the System of Award Management (SAM).

Sources Sought Notice

This Sources Sought Notice (SSN) is issued by the Indian Health Service (IHS) for market research and planning purposes to assess industry capabilities for providing expert consultation services related to Contract Support Costs (CSC) and Contract Disputes Act (CDA) claims analysis. The information gathered will help determine the appropriate acquisition strategy and set-aside approach.

The contractor will be expected to provide services including:

• Claims Analysis: Obtaining, reviewing, and analyzing claims submitted by Tribes and Tribal organizations, identifying claim types, methodologies, and required documentation. This includes assessing accuracy, adherence to agency policy, and proper use of Negotiated Indirect Cost Rate Agreements (NICRAs).

• Contract Support Cost Analysis Support: Providing analysis of CSC proposals, calculations, and ensuring consistency with ISDEAA requirements and IHS CSC Policy. This includes resolving discrepancies and assisting in negotiations.

• Document Preparation: Creating and finalizing various documents related to CDA or CSC matters, such as legal letters, internal memorandums, and presentations.

• Developing tools and processes for CSC and CDA claims analysis, including dashboards, procedure documents, and corrective action plans.

• The anticipated period of performance is a 12-month base period with four 12-month options.

• Initial award is anticipated in August 2026.

• Interested businesses must submit a capability statement demonstrating their expertise and technical capabilities.

• The capability statement should include a cover page, executive summary, technical objectives, and past performance.

• Specific requirements for key personnel include demonstrated expert-level experience in ISDEAA, CSC, and CDA claims analysis. Positions at Manager level and above must be Certified Public Accountants (CPAs), and Senior Manager positions and above must have at least 3 years of experience with ISDEAA contract support cost issues.

• Responses are due by May 29, 2026, no later than 5:00 PM EST.

• Indian Economic Enterprises (IEE)

• Small business concerns

• Other than small business concerns

• This SSN is for market research only and does not constitute a solicitation or obligation to award a contract.

• Generic capability statements are not sufficient.

• The tailored capability statement should not exceed 10 pages (excluding past performance information).

• All proprietary information should be marked as such.

• No classified, confidential, or sensitive information should be included in the response.
