This solicitation is for the procurement of Defense Maritime Solutions (DMS) Brand equipment, services, and parts. The scope includes management, supervision, general services, repair services, routine/periodic/annual service maintenance, corrective maintenance, shop maintenance, shop work, design, drawings development, technical representative visits, engineering, grooming, and root cause analysis for DMS Brand Equipment. This is a non-exhaustive list, and additional related services may be required.

• Vendors must be an Original Equipment Manufacturer (OEM), OEM authorized dealer, OEM authorized distributor, and/or MSC Design Control Activity qualified non-OEM offeror/vendor.

• Non-OEM qualified contractors must have an approved MSC non-OEM certification letter at the time of award.

• Cybersecurity Maturity Model Certification (CMMC) Level 1 (Self) is required for all information systems processing, storing, or transmitting Federal Contract Information (FCI) or Controlled Unclassified Information (CUI).

• Critical Safety Items include DMS brand propulsion and steering equipment.

• This is an Indefinite Delivery/Indefinite Quantity (IDIQ) Multiple Award Contract (MAC).

• Shared ceiling for the IDIQ MAC is $98,000,000.00.

Performance Work Statement (PWS)

This Performance Work Statement (PWS) outlines the requirements for an Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract to procure Defense Maritime Solutions (DMS) Brand equipment, services, and parts for Military Sealift Command (MSC). The goal is to ensure the continued maintenance and support of DMS Brand Equipment installed on MSC vessels.

The contract covers a broad range of services and parts related to DMS Brand Equipment, including but not limited to:

• Management and supervision
• General services, repair services, and parts/equipment storage
• Routine, periodic, and annual service maintenance
• Corrective maintenance and shop work
• Design, drawings development, and engineering support
• Technical representative visits
• Root Cause Analysis (RCA)
• Supply of materials, parts, components, kits, and entire equipment packages.

Specific DMS Brand Equipment mentioned includes Stern Tube Seals, Propulsion Systems, Emergency Diesel Generators (EDG), Ship Service Diesel Engines (SSDG), and Main Propulsion Diesel Engines (MPDE), along with numerous sub-systems.

• Performance will be evaluated using a Quality Assurance Surveillance Plan (QASP).

• Key performance areas include Personnel Manning, Timeliness and Accuracy of Deliveries, Accuracy of Deliverables (CDRLs), Period of Performance (POP) Schedule, Quality of Service, Trafficking in Persons compliance, Timeliness and Accuracy of Quotes, Whistleblower Clause compliance, and Fair and Reasonable Pricing.

• Performance will be documented in the Contractor Performance Appraisal Reporting System (CPARS).

• The contract is a five (5) year ordering period with a six (6) month option.

• Places of performance will be indicated on each Task Order (TO) or Delivery Order (DO) and will primarily be onboard MSC vessels, which may be moored at Government facilities, commercial repair facilities, or underway. Work may be required in various CONUS and OCONUS locations.

• Key Personnel: A Program Manager (PM) and Assistant Program Manager (APM) are required with specific qualifications and experience.

• Parts: Emphasis on OEM parts or approved non-OEM equivalents. Documentation for equivalent quality is required.

• Documentation: Technical manuals and Technical Support Data (TSD) are required for procured equipment.

• Travel: Travel costs will be determined at the TO/DO level and must adhere to DoD Joint Travel Regulations (JTR).

• Warranty: A one (1) year warranty is required for all provided services and installed parts.

• Subcontracting: Subcontractor utilization requires notification and approval from the Contracting Officer (KO) and Principal Port Engineer (PPE).

• Security: Personnel may require security clearances for facility access.

• The solicitation is for a sole source/limited source basis to specific companies, but all responsible sources may submit a capability statement, proposal, or quotation.

• Offerors must comply with all terms, conditions, and provisions, including those in the PWS.

• Price proposals must be held firm until awarded.

• Service Contract Labor Standards (SCLS) are not applicable to this requirement.

Form / Attachment / Pricing Sheet

This document is a Non-Disclosure Agreement (NDA) required for Offerors to access technical data, computer software, or both related to MSC Vessels. It outlines the terms and limitations for handling sensitive information provided by the Government.

• Data Usage: The Offeror agrees to use the provided "Data" solely for preparing a proposal in response to solicitation N3220526R0029 and for performing the resulting contract if awarded.
• Restrictions: The Offeror must comply with dissemination restrictions, export controls, and regulations. Unauthorized copying, release, reproduction, distribution, or making the Data available to unauthorized individuals is prohibited.
• Subcontractor Flow-down: If subcontractors are used, their names, addresses, and corporate principal contact information must be provided. Subcontractors must also execute a similar NDA.
• Return or Destruction: Upon notice of award to another entity or completion of work, the Offeror must return or destroy all Data and certify destruction in writing.
• Liability: The Offeror is responsible for unauthorized disclosures and must reimburse the Government for costs incurred due to such breaches.

This NDA is a mandatory requirement for any Offeror who will be provided with technical data or computer software related to the opportunity. Bidders must understand and agree to these terms to access the necessary information for proposal preparation and contract performance. Failure to comply can result in significant liability.

• Data Item No. B0001: Condition Found Report (CFR): Requires submission of corrective maintenance results, including automation testing, inspections, and any abnormal conditions found. Notification of abnormal conditions is required immediately, with a written CFR due within three business days. The report must include specific details such as date/time, location, contractor name, vessel name, contract number, and "as found" condition with suggestions.
• Data Item No. B0002: Post Overhaul Report: Required for rendered services (excluding parts-only orders) within 10 days of service completion. The report details maintenance performed and equipment conditions, utilizing a contractor's standardized form. It must be submitted in digital format to the Principal Port Engineer (PPE) and Ship's Chief Engineer (CHENG).
• Data Item No. B0003: List of Required Tools/Equipment: Contractors must provide a detailed list of tools, equipment, and industrial assist to be provided by the government or third parties for Task Orders/Delivery Orders (TO/DOs). This list is due with the TO/DO proposal.
• Data Item No. B0004: Tasking Spreadsheet: On an as-needed basis, contractors may be required to provide a tracking spreadsheet in Microsoft Excel format for each TO/DO and its associated deliverables. This spreadsheet should include the date, description, and completion percentage of each TO/DO, as well as Program & Project Manager contact details. It is to be submitted monthly and as necessary.
• Data Item No. B0005: FAR 52.222-56 Certification Regarding Trafficking in Persons Compliance Plan: Requires the contractor to submit a formal certification confirming the implementation of a Trafficking in Persons Compliance plan. This certification is due with the initial proposal and annually thereafter.
