Justification and Approval (J&A) for Brand Name/Brand Name or Equal Requirement

This document provides the justification for the Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, to acquire certain supplies. It addresses two matters: first, justifying the solicitation of a specific Brand Name Only item on a basis other than full and open competition, and second, justifying the use of "Brand Name or Equal" descriptions for other items to be solicited competitively.

• Brand Name Only Item: The acquisition includes one item that must be procured as Brand Name Only: Combi Oven, Electric, Make: Rational, Model: ICP 6-FULL ON-FULL E.

• Brand Name or Equal Items: The following items are solicited as Brand Name or Equal, allowing for the submission of alternate products that meet the Government's minimum needs:

• The acquisition will be issued as a Request for Quotations (RFQ).

• The contracting officer determined the anticipated cost to the Government will be fair and reasonable.

• For "Brand Name or Equal" items, the solicitation will encourage competition by allowing alternate products. Submitted technical data packages for alternates will be forwarded to the customer for acceptability determination.

• For the Brand Name Only item, competition is limited to responsible sources capable of providing the specified item.

• The document does not specify any set-aside requirements. The items procured are publicly available commercial items.

• Installation requirements, including removal and disposal of replaced items, will be required of the awardee.

• The justification for Brand Name Only will be made available for public inspection with the solicitation, redacted as necessary.

• The solicitation will be open to any responsible source capable of providing the specified brand name item.
