This document is the Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise (IEE) Representation Form. It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as defined by the Buy Indian Act and HHSAR 326.601. This form is required in response to Sources Sought Notices, Requests for Information (RFIs), or Solicitations.

• Eligibility Requirements: The enterprise must meet the IEE definition at the time of offer, contract award, and throughout the contract performance period. Any change in eligibility requires immediate notification to the Contracting Officer.
• Documentation: Contracting Officers may request documentation of eligibility before awarding set-aside or sole source contracts under the Buy Indian Act.
• Registration: Successful offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
• Representation Section: Offerors must indicate whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, Certifying Signature, Print Name, and UEI Number.

This form is critical for any bidder seeking to qualify for contracts under the Buy Indian Act. Bidders must accurately complete this self-certification and ensure they meet the ongoing eligibility requirements. Failure to do so, or providing false information, can lead to penalties and disqualification.

Sources Sought Notice

This notice is issued by the Dzilth-Na-O-Dith-Hle Health Center (DZHC), an Indian Health Service (IHS) facility, for market research purposes. It is not a Request for Proposal (RFP). The objective is to identify qualified Indian Economic Enterprises (IEEs) and Indian Small Business Economic Enterprises (ISBEEs) capable of providing on-site mobile document shredding services. The information gathered will help determine the acquisition strategy, with a potential set-aside under the Buy Indian Act.

• Service: Monthly on-site collection and cross-cut shredding of paper documents (strip shredding is not acceptable).

• Containers: Contractor must provide, deliver, and maintain three (3) 95-gallon, lockable security containers.

• Operations: Services to be performed on-site during normal business hours (Monday-Friday, 8:00 AM – 4:30 PM), excluding federal holidays.

• Compliance: Services must comply with HIPAA, the Privacy Act of 1974, and NAID certification standards. Contractor personnel must be trained, bonded, and uniformed.

• Business Associate Agreement (BAA): Required for handling Protected Health Information (PHI).

• Deliverable: A Certificate of Destruction (COD) must be provided after each service.

• Period of Performance: One (1) base year with four (4) one-year option periods.

  • Base Period: July 1, 2026, to June 30, 2027
  • Option Year One: July 1, 2027, to June 30, 2028
  • Option Year Two: July 1, 2028, to June 30, 2029
  • Option Year Three: July 1, 2029, to June 30, 2030
  • Option Year Four: July 1, 2030, to June 30, 2031

• Response Due Date: Thursday, June 18, 2026, at 2:00 PM Eastern Time (EST).

• Submission Format: Capability statement (not to exceed five pages).

• Content Requirements:

  • Part I: Business Information (Company Name, UEI, Buy Indian Act Status with completed IHS-BIA-FORM-1, business size).
  • Part II: Capability & Experience (Description of capabilities, at least two examples of similar services within the last 3 years, confirmation of cross-cut shredding ability, NAID certification, trained/uniformed personnel, and description of 95-gallon containers).

• This notice seeks information from qualified Indian Economic Enterprises (IEEs) and Indian Small Business Economic Enterprises (ISBEEs).

• Priority will be given to a set-aside under the Buy Indian Act.

• Small Business Size Standard: For NAICS code 561990, the SBA size standard is $16.5 million in average annual receipts.

• This notice is for market research only and does not constitute a Request for Proposal (RFP).

• The Government will not award a contract based on this notice.

• No payment will be made for submitted information.

• All submission costs are at the respondent's expense.

• Proprietary information will be handled as such.
