Statement of Work (SOW) / Performance Work Statement (PWS)

This document establishes a Basic Ordering Agreement (BOA) for the Department of War (DoW) Radioactive Waste Program, managed by the U.S. Army as the Department of War Lead Agent (DOWLA). The program's mission is the safe, compliant, and cost-effective disposal of low-level radioactive waste (LLRW) and related materials worldwide.

The BOA outlines a framework for future task orders to manage excessed or unwanted radioactive materials. Work is categorized into six tiers, ranging in complexity:

• Tier 1: Low-Level Radioactive Waste (LLRW) packaging, shipping, and disposal.
• Tier 2: Low-Level Mixed Waste (LLMW) packaging, shipping, and disposal (includes hazardous materials).
• Tier 3: Decommissioning Support, including radiological surveys for compliance.
• Tier 4: Site Disposal Operations, involving long-term mobilization for remediation projects.
• Tier 5: Technical Radiation Protection, NOS (Not Otherwise Specified).
• Tier 6: Emergency Response for incidents involving DoW radioactive materials.

Contractors will receive project-specific requirements through Task Order Performance Work Statements (PWS-A), which supplement this Basic Performance Work Statement (PWS-B) and tier-specific requirements.

Key performance objectives include adherence to schedules, timely and accurate invoicing, and submission of required reports and deliverables. Performance will be evaluated, and unsatisfactory performance can lead to removal from the BOA.

Task orders will be issued under this BOA. Performance locations are worldwide, including Continental United States (CONUS) and Outside Continental United States (OCONUS) sites. Specific periods of performance will be defined in each Task Order.

• Eligibility: Awards under this BOA will be competed among businesses with an 8(a) Small Business Designation certified by the SBA.
• Licensing: Contractors must possess appropriate radioactive material licenses and acquire reciprocity as needed.
• Personnel: Contractors must supply qualified personnel, including trained waste shippers/brokers.
• Compliance: Strict adherence to all DoW, Federal, State, and local laws and regulations is required.
• Communication: All communication must be coordinated through the Contracting Officer (KO) or Contracting Officer’s Representative (COR).
• Task Orders: Task orders are firm-fixed price. Non-severability applies once waste is shipped. Modifications to existing task orders for regional efficiencies or added inventory are possible.

• Authorized use conditions and jurisdictional procedures (refer to Addendum 1)

Section 5: Evidence of Decommissioning Support

• Submission of Final Status Survey (FSS) Plan or Report
• Narrative detailing company's direct involvement in FSS development/execution.

Section 6: Evidence of Site Disposal Operations

• Submission of a 2-page Statement of Qualifications on prior waste disposal experience.

Section 7: Tier Qualification Self-Assessment

• Self-assessment against technical criteria for six contract tiers (detailed in Addendum 3).
• Selection of applicable tiers and a justification narrative (max 500 words) referencing Addendum 3 criteria.

Section 8: Comments

• Explanation for not submitting a proposal, or necessary changes to enable proposal submission.

Completion of this questionnaire is mandatory for submission to the BOA. It gathers essential company, status, and experience information required for qualification and tier assignment. Bidders must carefully review all sections and provide detailed, accurate responses, including necessary attachments and narratives, to be considered for this opportunity.

This document outlines the government's policy regarding the use of Artificial Intelligence (AI) tools in the evaluation of offeror proposals. It informs bidders about how AI may be employed during the review process.

• AI Use in Evaluations: The government may use AI tools to assist in analyzing proposals, including summarizing content, checking compliance with requirements, and identifying potential strengths, weaknesses, or risks.
• Inherently Governmental Functions: Final evaluation judgments, ratings, and source selection decisions will remain exclusively with government personnel. AI tools will not be delegated decision-making authority.
• Confidentiality and Data Protection: AI tools will be used in compliance with regulations protecting proprietary and source selection sensitive information. The systems are output-only, and proposal data will not be saved or transmitted to external systems without appropriate safeguards.

Bidders should be aware that AI may be used as a tool in proposal evaluation. While AI may assist in analysis, all final decisions rest with government personnel. The government assures that proprietary and sensitive information will be protected in accordance with regulations.
