Terms and Conditions

This document outlines the "Terms and Conditions" applicable to solicitation 70Z03826QB0000130. It supersedes all other terms and conditions and acceptance of an order constitutes acceptance of these terms.

• Instructions to Offerors (52.212-1): Offers must hold prices firm for 60 calendar days. Quotations require the "Requirement" document (Attachment 1) with the unit price column completed.

• Evaluation (52.212-2): This solicitation is anticipated as a Total Small Business Set-aside. Award will be made to the lowest priced offeror rated technically acceptable. Technical Acceptability will be evaluated on the offeror's ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source, and must include exact part numbers listed on the requirements schedule.

• Price: Offerors shall provide pricing as requested. Quantity price discounts and prompt payment discounts should be included. Quotations will be evaluated for fairness and reasonableness.

• Certifications and Representations: Several provisions require certifications regarding responsibility matters (52.209-5), including debarment, suspension, criminal convictions, and delinquent federal taxes. Additionally, representations are required regarding felony convictions (52.209-11) and prohibitions related to covered telecommunications equipment/services, FASCSA orders, Sudan, and Iran (52.240-91).

• Quality Assurance: Applicable to orders for products touching USCG aircraft. Requires immediate notification of any event, supply change, material change, malfunction, or counterfeit/suspect parts that could cause non-conformity. Government reserves the right to inspect. Contractor's quality control manual must detail risk management, testing, and inspection processes.

• Packaging, Marking, and Shipping: Specific instructions are provided for packaging (no popcorn, shredded paper, Styrofoam, or peanut packaging), marking (including NSN, Part Number, etc.), and shipping to the USCG Aviation Logistics Center.

• Inspection and Acceptance: Performed at destination by local USCG personnel. A Certificate of Conformance (COC) is required for all items, signed by an authorized official of the approved source, and must reflect unbroken history of ownership. Full and clear traceability is mandatory.

• Option for Increased Quantity (52.217-6): The Government may increase the quantity for Line Item 1 by up to 10 units, for a maximum of 20 units, within one year of award.

• Sustainable Products and Services (52.223-23): Requires compliance with various statutory mandates and directives for purchasing sustainable products and services.

• Many provisions include deviations (indicated by "(DEVIATION)").

• Offerors are cautioned that listed provisions incorporated by reference may require completion and submission.
