Justification for Sole Source
This acquisition was conducted using other than full and open competition (10 U.S.C. 3572) due to the unique qualifications and proprietary data rights held by Ellcie Maintenance GmbH, the OEM. Ellcie GmbH is the sole known source possessing the required proprietary parts, software, and expertise for the Mira-X LC-SEM. Performing services by unauthorized third parties would void the existing warranty. The government will negotiate a fair and reasonable price.
Additional Notes
While this was a sole-source acquisition, the government is committed to promoting future competition by seeking data usage rights and continuously monitoring the marketplace for alternative sources.
