The Government retains sole discretion in determining whether to proceed with a full and open competition based on responses to this notice.

Additional Notes

NASA's justification for the sole source includes:

  • SpaceX is the only NASA-certified CTS provider, having successfully launched twelve PCMs to the ISS.
  • The need to maintain uninterrupted human spaceflight capability to the ISS, as mandated by the NASA Transition Authorization Act of 2017.
  • Factors such as recently shortened ISS mission durations, technical issues and schedule delays encountered by Boeing (the other CCtCap contractor), mission allocation between providers, and projections for alternative CTS availability.
  • Awarding additional PCMs to SpaceX is deemed essential to ensure continuous flight access for ISS operations and to mitigate risks from potential anomalies or external factors.
  • The Government does not intend to acquire a commercial product or service using FAR Part 12.
