• P3s vs. Leases: A P3 contract is not a lease. For EULs, the Army can waive the right to terminate a lease, except in cases of uncured default.
• Non-DoD Operations: Companies can lease land and conduct non-DoD operations under 10 U.S.C. 2667, with the relationship being that of landlord and tenant.
• Budget and Funding: Future budgets for ARMS are uncertain, and current budgets have been significantly reduced. The Army is allocating funds for alternative chemistries to reduce reliance on foreign sources.
