Quick Summary

The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 21, has issued an Intent to Sole Source Notice for a Controlled Substance Removal Program for the VA Palo Alto Health Care System (VAPAHCS) Pharmacy. The VA intends to award a firm-fixed-price contract to EWA Direction as a certified Service-Disabled Veteran-Owned Small Business (SDVOSB), citing statutory authority for sole source awards. Interested parties capable of fulfilling this requirement must submit a Market Research Questionnaire by May 21, 2026, 12 PM PST.

Scope of Work

The program aims to ensure full compliance with VHA Directive 1108.01 and Title 21 CFR for the secure handling, deactivation, and disposal of expired, damaged, or unwanted controlled substances. Services include:

  • Provision, installation, and maintenance of secure disposal containers that immediately deactivate controlled substances.
  • Continuous supply and replenishment of containers.
  • Training and program implementation support for VA staff.
  • Compliance assurance, documentation, and audit readiness support.
  • Risk management, diversion prevention, and security measures.
  • Ensuring disposal methods meet DEA destruction standards and environmental regulations. Performance will occur at VA facilities in Palo Alto, Menlo Park, Livermore, Fremont, and San Jose, CA.

Evaluation & Sole Source Justification

This is an intent to sole source notice under 41 USC §3304(a)(5) and 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 and VAAR 819.7008/819.7009 (DEVIATION) for sole source awards to certified SDVOSBs. The Government will consider responses to the Market Research Questionnaire to determine if a competitive acquisition is viable. If no viable responses are received by the deadline, NCO 21 will proceed with negotiations solely with EWA Direction.
