Justification & Evaluation
This procurement is justified under 10 U.S.C. Section 2304(c)(1) and FAR 6.302-1, citing "Only one responsible source." The Modal Shop, Inc. (TMS) is the design activity and OEM of the SVCS, possessing unique knowledge, experience, and technical expertise required to produce replacement systems for the US Navy/Marine operational environment without developmental effort. TMS does not have authorized distributors capable of meeting technical data requirements, and the Government does not own the technical data. This is not a request for competitive proposals. Responses will be considered solely to determine if a competitive procurement is feasible.
