• The Offeror agrees to use the Data solely for proposal preparation in response to solicitation N3220518R4002 and for performance of the resulting contract.
• The Offeror must comply with restrictions on dissemination, export controls, and regulations.
• Organizational controls must be established to limit access to authorized representatives.
• The Data cannot be copied, released, reproduced, distributed, or made available to unauthorized individuals.
• The Offeror must identify any vendors/subcontractors and ensure they execute a similar flow-down NDA.
• The Data must be returned or destroyed upon notice of award to another entity or completion of work.
• The Offeror must cooperate with the Government in recovering or destroying improperly released Data and reimburse costs associated with unauthorized disclosures.

Bidders must execute this NDA to gain access to the technical data required for preparing their proposal in response to solicitation N3220518R4002. Failure to comply with the terms of this agreement may result in penalties and costs. Bidders must also ensure any subcontractors execute a similar agreement.
