Justification and Approval (J&A) for Other Than Full and Open Competition

This document justifies the Department of Veterans Affairs' intent to award a sole-source contract for Architect Engineer (AE) Construction Period Services (CPS). These services include participation in pre-bid and pre-construction conferences, responding to RFIs, reviewing submittals, providing expert insight into AE Design documents, preparing additional drawings/specifications, and conducting site visits.

• Authority: VAAR 819.7008 (DEVIATION) for sole source awards to Service-Disabled Veteran-Owned Small Businesses (SDVOSB).

• Contractor: Apogee Consulting Group, P.A., an SDVOSB and the original Designer of Record (DOR).

• Rationale: This is a follow-on to a previously descoped contract. Sole sourcing to the DOR is intended to decrease lead times for the construction project award and ensure the DOR's availability for expertise related to their design documents. It is deemed unnecessarily burdensome to solicit and evaluate other SDVOSB firms.

• Market research identified 4,515 SDVOSB firms nationwide and 141 in Alabama capable of performing similar tasks.

• However, no other sources were sought for these specific AE services due to the rationale above.

• This document is a Justification and Approval (J&A) and not a solicitation. A Pre-Solicitation Notice was posted on 2/12/2026.

• The proposed award is pending negotiation of a fair and reasonable price, using the Independent Government Estimate and previous contract pricing as references.

• The proposed award is to a Service-Disabled Veteran-Owned Small Business (SDVOSB).

• The original design was completed under a separate contract, and CPS services were descoped from that contract.

Notice of Intent to Sole Source

The Department of Veterans Affairs (VA) intends to award a sole/single source, firm-fixed-price contract for construction period services (CPS) to APOGEE CONSULTING GROUP, P.A. for Project 619A4-24-102: Replace Roofs Buildings 19, 20, 50, 51 and 62, AE CPS at the Central Alabama Veterans Healthcare System (CAVHCS).

This is a follow-on to a previously descoped contract. Retaining the A-E designer of record (DOR) is intended to decrease lead times for award of the construction project and ensure the DOR's expertise is available for their own design documents.

Required AE CPS services include, but are not limited to:

• Construction submittal reviews

• Responses to contractor Requests for Information (RFI's)

• Execution of design changes and potential design changes

• Attendance at necessary site visits and construction-related meetings

• The acquisition is anticipated to take place on or about 3/20/2026.

• The NAICS code is 541330 with a size standard of $25.5M.

• This notice is NOT a request for competitive proposals. No solicitation will be issued on SAM.gov, and no response is requested.

• However, any System for Award Management (SAM) registered firm that believes it can meet the requirement may provide a capability statement or proposal.

• Such a response should include an explanation of how the firm could complete the CPS services as efficiently and effectively as the DOR.

• Any prospective firm must possess working knowledge of all issues that may arise and will assume liabilities associated with all aspects of the design.

• Responses must be provided by 2/27/2026 at 1:00 PM ET.

• Information received will be considered for market research to determine whether to conduct a competitive procurement.

• There will be no reimbursement for developing a response.
