The acquisition is conducted under statutory authority 41 U.S.C. 1901 (Simplified Acquisition Procedures) as implemented in FAR 13.106-1(b)(2), citing only one responsible source and no other services will satisfy agency requirements.

• Support must be provided by the Original Equipment Manufacturer (OEM), Medtronic USA, Inc., or an authorized entity.

• No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. Only new OEM items are permitted.

• No gray market or counterfeit items are allowed.

• Vendor must be an OEM, authorized dealer, authorized distributor, or authorized reseller, verified by an OEM authorization letter.

• Vendor must be able to purchase OEM parts, have OEM-certified technical personnel, utilize OEM billable services (if applicable), and abide by a response time of on-site service within one (1) business day.
