Purpose & Scope
This Request for Proposals (RFP) seeks private, public, or not-for-profit entities to lease DA land for developing mineral processing facilities. Offerors must design, finance, permit, develop, construct, install, own, maintain, operate, secure, and decommission the facilities. The project must be viable without any monetary or other contribution from the DA. Offerors may propose projects on all or a portion of the properties at any one or more of the installations. The available properties include approximately 97 and 52 acres at Anniston Army Depot, 25 acres at Fort Drum, and 245 acres (Site B) at Pine Bluff Arsenal.
Contract Details
- Type: Enhanced Use Lease (EUL) under 10 U.S.C. § 2667. This is a real estate transaction, not governed by the Federal Acquisition Regulation (FAR).
- Term: An initial term of fifty (50) years, with an option to renew for an additional period if proposed by the Offeror.
- Consideration: Payment to the DA can be in-kind, cash, or a combination, and must not be less than the fair market value of the lease interest. The DA prefers in-kind consideration, such as construction, restoration, or maintenance services.
- Lessee Responsibilities: The selected Lessee(s) will be responsible for all project costs, obtaining necessary permits, and complying with all applicable federal, state, and local laws, codes, ordinances, and regulations, including environmental standards (e.g., NEPA, CERCLA, RCRA, NHPA, ESA) and the Davis-Bacon Act. The property will be leased "as-is/where-is," and the Lessee must restore it to its original condition prior to the EUL's expiration. A decommissioning bond will be required.
