Justification for Other Than Full & Open Competition

This document justifies the acquisition of specific supplies/services through other than full and open competition. The action involves negotiation and award of a contract for items that are either spares, repair/overhaul, modifications, management, piece parts, or data reports.

• Nomenclature, NSN, P/N, Quantity, Cage Code, and Unit Price are "SEE ATTACHED".

• Estimated Value is provided.

• Period of Performance: Expected Final Delivery Date is 06/07/2026.

• The justification is based on 10 USC 3204(A)(1), allowing for situations where only one or a limited number of responsible sources can satisfy agency requirements, as implemented by FAR 6.302-1.

• The government does not own the data or rights to the data needed to contract repair from additional sources.

• It is deemed uneconomical to buy the data/rights or to reverse engineer the part.

• This acquisition is specifically being solicited to Sargent Aerospace & Defense, LLC (CAGE 78062) as they are identified as the only capable source with the required technical data to manufacture/repair, test, and certify the item prior to delivery.

• NAVSUP-WSS must procure the item/repair from Sargent Aerospace & Defense, LLC because the Navy lacks sufficient rights to the data for a full and open competitive solicitation.

• A Request for Information / Sources Sought Notice was posted on 08/07/2025, with no responses received.

• The proposed contract action was synopsized on 08/21/2025, also with no responses received.

• Market research was conducted per FAR Part 10. Mandatory sources of supply were reviewed and found not capable of providing the requirement.

• The item has been deemed "Non-Critical".

• A DD2579 will be submitted to the SBA for approval.

• A synopsis will be posted for 15 days.

• The award will be a firm-fixed-price contract using Lowest Price Technically Acceptable (LPTA) evaluation criteria.

• NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package (TDP) for review and source approval to promote future competition.

• Future requirements will be advertised on SAM.gov.

• The contracting officer determines that the anticipated cost will be fair and reasonable. An analysis of cost information will be performed if certified cost and pricing data is required.
